There’s A Lot of Wins Out of HHS!

This week has been a testament to everything Robert F. Kennedy promised he would do - the Department of Health and Human Services is committed to MAHA, and it shows! https://x.com/SecKennedy/status/1899978028530249881

Kennedy held a roundtable with MAHA moms this past week to discuss getting healthy, nutritious food into the bellies of our precious kids! What did they discuss? Among the topics, they talked about how Secretary Kennedy has already met with leading packaged food companies about removing food dyes from their products, directed the FDA to reform their standards, announced an intention to ensure the US leads the world in the production of healthy baby formula, and vowed to provide nutritious foods to lower-income children through the SNAP Program. It was the first of what will be many more roundtable discussions as the MAHA Commission works to make America Healthy Again from inside the government. MAHA moms are crucial to our movement, and there is no force more powerful on earth than these women protecting all of our kids!

Also this week, Secretary Kennedy announced that he has directed the FDA Commissioner to explore potential rulemaking to revise its Substances Generally Recognized as Safe (GRAS) Final Rule. This will enhance the FDA’s oversight of ingredients considered to be GRAS and bring transparency to American consumers. Senator Kennedy said of the initiative:

“For far too long, ingredient manufacturers and sponsors have exploited a loophole that has allowed new ingredients and chemicals, often with unknown safety data, to be introduced into the U.S. food supply without notification to the FDA or the public,” said Secretary Kennedy. “Eliminating this loophole will provide transparency to consumers, help get our nation’s food supply back on track by ensuring that ingredients being introduced into foods are safe, and ultimately Make America Healthy Again.”

Legislation YOU Need to Know About

MAHA has been busy, and so have all of you! One of the most important things we can do as a grassroots group of passionate activists is lobby our state and local governments to ensure that the MAHA Agenda is solidified at the state level. Our new legislative tool, located here, has a list of bills we are mobilizing around. You can use this tool to track legislation in your state, contact your lawmakers, and more!

You may have seen some of the stunning testimony on social media this week, where young filmmaker and activist Grace Price testified in front of the TX Senate in favor of a bill to preclude SNAP funds from being used to purchase junk food. At the same time, the American Heart Association lobbied AGAINST it! This exchange perfectly encapsulates why it is more important than ever for YOU to get involved. Watch the startling footage here. MAHA Action is proud to partner with organization End Chronic Disease as we continue to build an unstoppable movement committed to Making America Healthy Again.

Arizona -

HB2164: VERDICT: MAHA SUPPORTS

The Arizona Healthy Schools Act, effective from the 2026-2027 school year, bans schools in federally funded meal programs from serving or selling ultra-processed foods on campus during school hours. These foods include those with additives like potassium bromate, propylparaben, titanium dioxide, brominated vegetable oil, and specific food dyes (e.g., Yellow 5 and 6, Blue 1 and 2, Green 3, Red 3 and 40). The Department of Education will oversee compliance through a certification form and a public list of compliant schools. Parents can still provide these foods to their kids. The law targets childhood obesity and exposure to harmful additives, aiming to enhance student health and nutrition.

The MAHA “Why?” MAHA supports this bill. The Arizona Healthy Schools Act represents a meaningful step towards promoting healthier eating habits and reducing the risks associated with ultra-processed foods in schools. This bill prioritizes student health and nutrition by prohibiting the sale of foods with harmful additives and setting a clear pathway for compliance. It addresses critical concerns such as childhood obesity and the negative impact of synthetic additives while still allowing parents the flexibility to provide alternative options. The long-term benefits of this legislation will contribute to better health outcomes for students, making it a positive move for public health and wellness.

New York -

A01908: VERDICT: MAHA SUPPORTS

This bill requires healthcare providers to give patients detailed vaccine information at least 48 hours before administration. Providers must share information on the vaccine’s safety, benefits, risks, and potential side effects, a full list of ingredients from the manufacturer, the CDC’s excipient summary, and instructions on reporting adverse events. The bill amends public health law to ensure patients are fully informed about vaccines, enhancing transparency and awareness of potential risks before receiving immunizations.

The MAHA “Why?” MAHA supports this bill. It emphasizes transparency and informed consent, ensuring patients are fully educated about vaccines before receiving them. Mandating that healthcare providers disclose detailed vaccine information, including risks, benefits, ingredients, and potential side effects, empowers individuals to make well-informed decisions about their health. This approach will increase patient awareness and foster trust in the healthcare system by prioritizing transparency and patient autonomy. The requirement to provide this information 48 hours in advance further ensures that patients have enough time to consider their options, aligning with principles of informed consent and patient rights.

Iowa -

SF394: VERDICT: MAHA STRONGLY OPPOSES

This Iowa bill offers legal protection to pesticide manufacturers and users registered with the EPA by creating a defense against civil lawsuits. It deems a pesticide label legally sufficient under state law if it is either directly approved by the EPA, complies with the latest FIFRA human health assessment, or matches the EPA’s carcinogenicity classification. Meeting any of these federal standards shields manufacturers and users from tort liability related to state warning requirements, aligning Iowa’s standards with EPA guidelines for consistency.

The MAHA “Why?” MAHA strongly opposes this bill as it shields foreign pesticide companies like Bayer and ChemChina from accountability rather than prioritizing public health, environmental safety, and consumer protection. By granting pesticide manufacturers legal immunity based on EPA-approved labeling, this legislation severely limits the ability of individuals to seek justice for harm caused by pesticide exposure. Given Monsanto's history of legal battles over toxic products like Roundup, this bill appears to be more about corporate protection than genuine safety standards. Regulatory approval does not equate to absolute safety, especially when industry influence over agencies like the EPA is well-documented. Transparency, independent oversight, and the right to legal recourse must precede corporate immunity.

Tennessee -

HB0809/SB0527: VERDICT: MAHA STRONGLY OPPOSES

These are identical bills, one in the State House and one in the State Senate. Like the Iowa bill, this Tennessee bill reduces the liability of pesticide manufacturers and sellers in civil lawsuits over labeling issues. If a pesticide is registered with both the Tennessee Commissioner of Agriculture and the EPA under FIFRA, and its label was EPA-approved at the time of sale, they are protected from product liability claims, including failure to warn lawsuits. This shield does not apply if the pesticide violates state or federal regulations. Effective immediately upon passage, the law aims to protect companies by recognizing EPA-approved labels as a sufficient legal defense.

LEGISLATIVE WIN!

Texas - SB25 “Make Texas Healthy Again!” SB25 has passed in Texas! Senate Bill 25, by Sen. Lois Kolkhorst, requires food labels to warn Texas consumers which ingredients are banned in other countries starting in 2027. SB 25 also requires daily physical education for students from kindergarten to eighth grade and prohibits the removal of recess, physical education, and sports practice for disciplinary reasons. Additionally, the bill requires nutrition education for students in Texas high schools and institutions of higher learning, along with updated nutrition training for all Texas physicians, medical residents, nurses, physician assistants, and medical students.

SB 25 establishes a nutrition advisory council at the Department of State Health Services, focusing on metabolic health, functional medicine, and chronic disease.

LEGISLATIVE LOSS

Georgia—SB144 - SB144, like the other pesticide bills above, has passed in Georgia. It shields foreign pesticide companies like Bayer and ChemChona from accountability for harm rather than prioritizing public health, environmental safety, and consumer protection. There’s still time to call the Governor and demand that he VETO this bill when it arrives on his desk. Keep your eyes peeled for more communication with ways you can help.
